Another of the four businesses that successfully sued the City of Miami Beach for the right to “hawk” their products on Lincoln Road has closed. Forever Flawless, known for aggressively approaching passersby, has left its location at 704 Lincoln Road. The gentleman who answered the number to call for inquiries told RE:MiamiBeach he relocated to Colorado and the legal issues had nothing to do with his decision.
Despite winning the lawsuit in which the Eleventh Circuit Court ruled that hawking is protected as free speech, Forever Flawless is the second of the four businesses to close. Oceane, previously located at 437 Lincoln Road, is now part of The Crabster restaurant. Still operating is Timeless Cosmetics at 947 Lincoln which shares at least one owner and a registered corporate agent with Forever Flawless and Oceane.
The fourth, Brilliance NY, still operating at 631 Lincoln Road, does not appear to be affiliated with the others. A side note, their LLC is listed as inactive in the State of Florida database. It appears to have been dissolved for lack of a 2017 annual report.
When our story was written in September, City Attorney Raul Aguila said he would seek a rehearing. He planned to discuss the cost of litigation if the request for a rehearing failed in an attorney-client session at the City Commission meeting on September 13th. At that time he said he would seek guidance from the Commission on proceeding with the case or “exploring narrower legislative options”.
Yesterday, City Spokeswoman Melissa Berthier said the City was not able to comment on the status of the case.
